TERMS OF SERVICE

Balanced Allocate is operated by Cameron Wheeler as trustee for The Trustee for Wheeler Family Trust (ABN 65 889 062 943) (“Balanced Allocate”, “we”, “us”, “our”).
By accessing or using the Balanced Allocate web application (the “Service”), you agree to these Terms of Service.
1. Description of Service
Balanced Allocate provides a web-based optimisation tool that assists users in distributing people, projects or resources across groups subject to defined constraints.
The Service generates mathematical optimisation outputs based solely on user-provided inputs. Balanced Allocate does not guarantee business, financial, hiring, academic or operational outcomes resulting from use of the Service.
Users are responsible for reviewing and validating all outputs before implementation.
2. Accounts
Access to the Service requires creation of an account.
You agree to:
- Provide accurate information.
- Maintain the security of your login credentials.
- Be responsible for activity under your account.
We may suspend or terminate accounts that misuse the Service or breach these Terms.
3. Data Handling
Uploaded CSV files are processed in memory during your active session and are not stored on our servers.
Authentication is managed via a third-party provider (such as Auth0), which may store account credentials and login metadata (including timestamps and IP addresses) for security purposes.
Our hosting provider may generate standard server logs (including IP addresses and request metadata) for security, monitoring and operational purposes.
Billing is processed by Stripe. Balanced Allocate does not store full credit card details.
4. Subscriptions and Billing
Access to the Service is provided on a subscription basis and billed in advance via Stripe.
Subscriptions renew automatically unless cancelled. You may cancel at any time via the web application. Access continues until the end of the current billing period.
New users may receive a 14-day free trial. Trial eligibility is determined based on account creation date. We reserve the right to limit or withdraw trial access in cases of suspected abuse.
Fees are non-refundable except where required by Australian Consumer Law or at our discretion.
5. Acceptable Use
You agree not to:
- Upload unlawful, defamatory or discriminatory content.
- Attempt to reverse engineer, disrupt or overload the Service.
- Use automated methods to abuse computational resources.
- Use the Service in violation of applicable laws.
6. Intellectual Property
All software, algorithms, branding and content associated with Balanced Allocate remain our property.
You retain ownership of the data you input into the Service.
7. Limitation of Liability
To the maximum extent permitted by law, Balanced Allocate is not liable for indirect, incidental or consequential damages arising from use of the Service.
Our total liability is limited to the amount paid by you for the Service in the preceding 12 months.
Nothing in these Terms excludes rights under Australian Consumer Law.
8. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice via email or through the web application. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of Australia.
